Terms of Service

1. Eligibility

You must be at least 13 years old and legally able to enter into these Terms. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf when required by law. You may not use the Service if applicable law prohibits you from doing so.

2. Accounts and Security

You agree to provide accurate account information, keep it current, safeguard your login credentials, and promptly address suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of these Terms or applicable law. You may not transfer or share an account in a way that compromises its security.

3. The Service Is Not Investment Advice

InvestJournal is a research, journaling, organization, and discussion tool. It is not a broker, dealer, investment adviser, fiduciary, financial institution, tax adviser, legal adviser, or financial planner. Nothing in the Service is an offer, solicitation, endorsement, or recommendation to buy, sell, hold, or transact in any security, asset, or strategy.

You are solely responsible for evaluating information and making your own decisions. Investing involves risk, including possible loss of principal. Past performance, backtests, simulations, examples, projections, and hypothetical results do not guarantee future results. Consider consulting appropriately licensed professionals for advice specific to your circumstances.

4. Information and Market Data

Prices, news, filings, charts, calculations, analytics, community posts, and other information may be delayed, incomplete, inaccurate, unavailable, or affected by technical errors. We do not guarantee that information is timely or fit for trading or other decisions. You must independently verify important information before relying on it.

5. AI Features

AI-generated or AI-assisted output may contain errors, omissions, bias, or fabricated information. It is provided for organizational and informational purposes only and is not professional advice. You are responsible for reviewing output and verifying it against reliable sources before using or sharing it.

6. Your Content

You retain ownership of content you submit to the Service. You grant InvestJournal a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, process, transmit, and display that content only as reasonably necessary to operate, secure, improve, and provide the Service and as otherwise directed by you. This license ends when your content is deleted from our systems, subject to reasonable backup periods, legal obligations, and content shared with others before deletion.

You represent that you have the rights needed to submit your content and that it does not violate law or another person's rights. You are responsible for your content and the consequences of making it public.

7. Community Features

Public content reflects its author's views and is not verified or endorsed by InvestJournal. Other users may view, save, quote, discuss, or share public content. Do not publish confidential information, misleading performance claims, unlawful promotions, or content intended to manipulate a market. We may moderate or remove content, but we are not obligated to monitor all user activity.

8. Acceptable Use

You may not use the Service to:

• Break the law, facilitate fraud, manipulate markets, or violate another's rights;
• Post deceptive, defamatory, infringing, harassing, or unlawfully harmful content;
• Impersonate others or misrepresent your identity, affiliation, or investment results;
• Access another account or restricted systems without authorization;
• Introduce malware or interfere with the operation, integrity, or security of the Service;
• Scrape, crawl, or use automated means in a manner that burdens or circumvents the Service;
• Reverse engineer the Service except where applicable law expressly permits it; or
• Use Service output to build or train a competing product without written permission.

9. InvestJournal Intellectual Property

The Service, including its software, design, branding, and content supplied by InvestJournal, is owned by or licensed to InvestJournal and protected by applicable law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted. Feedback you voluntarily provide may be used without restriction or compensation to you, but we are not required to use it.

10. Third-Party Services

The Service may depend on or link to third-party services, data, and content. We do not control and are not responsible for third-party terms, privacy practices, accuracy, availability, or performance. Your use of a third-party service may be governed by a separate agreement with that provider.

11. Changes to the Service or Terms

We may add, change, suspend, or discontinue Service features. We may also update these Terms to reflect Service, legal, or operational changes. We will post updated Terms and revise the effective date; we will provide additional notice of material changes when required by law. Continued use after updated Terms take effect constitutes acceptance of those Terms.

12. Suspension and Termination

You may stop using the Service at any time. We may restrict, suspend, or terminate access, or remove content, if we reasonably believe you violated these Terms, created legal or security risk, or misused the Service. Where practicable, we will provide notice. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, and dispute provisions.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." INVESTJOURNAL DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INVESTJOURNAL AND ITS AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS OR DATA; TRADING OR INVESTMENT LOSSES; OR DAMAGES ARISING FROM RELIANCE ON CONTENT, SERVICE INTERRUPTIONS, USER CONTENT, OR THIRD-PARTY SERVICES. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless InvestJournal and its affiliates and personnel from third-party claims, losses, liabilities, and reasonable expenses arising from your content, your unlawful misuse of the Service, or your material violation of these Terms or another person's rights.

16. Disputes and Applicable Law

Before filing a formal claim, you and InvestJournal agree to make a good-faith effort to resolve the dispute informally by providing written notice and allowing 30 days for a response. These Terms are governed by applicable law, without overriding consumer protections that cannot be waived. Any proceeding must be brought in a court with lawful jurisdiction and venue. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

17. General Terms

These Terms and the Privacy Policy are the entire agreement regarding the Service. If a provision is unenforceable, it will be modified only as much as necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction or by operation of law.
